The following terms and conditions govern all use of the Learn With Cat website and all content, services and products available at or through the website. The Website is owned and operated by Cat Blount and is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies [including, without limitation, Learn With Cat’s Privacy Policy] and procedures that may be published from time to time on this Site by Learn With Cat/Cat Blount (collectively, the “Agreement”). Learn With Cat, within these terms of services is the same as Cat Blount and Catherine Blount.
Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the website, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services.
A. Payment and Renewal
Payment. By registering for a course, you agree to pay Learn With Cat/Cat Blount the single or ongoing subscription fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up for a course and will cover the use of that service for a single or ongoing subscription period as indicated. Fees are not refundable.
Renewal. Unless you notify Learn With Cat/Cat Blount before the end of the applicable subscription period that you want to cancel, your subscription will automatically renew and you authorize Learn With Cat/Cat Blount to collect the then-applicable weekly subscription fee for the course using any credit card or other payment mechanism we have on record for you. You can cancel your subscription at any time.
B. Responsibility of Website Users
You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Learn With Cat/Cat Blount disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.
C. Copyright Infringement and DMCA Policy
As Learn With Cat/Cat Blount asks others to respect its intellectual property rights, it respects the intellectual property rights of others.
D. Intellectual Property
This Agreement does not transfer from Learn With Cat/Cat Blount to you any Learn With Cat/Cat Blount or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with Learn With Cat/Cat Blount.
Learn With Cat/Cat Blount logo, and all other trademarks, service marks, graphics and logos used in connection with Learn With Cat/Cat Blount or the Website are trademarks or registered trademarks of Learn With Cat/Cat Blount. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any Learn With Cat/Cat Blount or third-party trademarks.
E. Changes
Learn With Cat/Cat Blount reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. Learn With Cat/Cat Blount may also, in the future, offer new services and/or features through the Website. Such new features and/or services shall be subject to the terms and conditions of this Agreement.
F. Termination
Learn With Cat/Cat Blount may terminate your access, use, and/or participation in and/or to all or any part of the Website, services, and/or courses provided by Learn With Cat/Cat Blount at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement you may simply discontinue using the Website and/or unsubscribe to any single and/or ongoing course.
All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, provisions, warranty disclaimers, indemnity and limitations of liability.
G. Disclaimer of Warranties
The Website is provided “as is”. Learn With Cat/Cat Blount hereby disclaim all warranties of any kind, express or implied. Learn With Cat/Cat Blount does not make any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.
H. Limitation of Liability
In no event will Learn With Cat/Cat Blount be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Learn With Cat/Cat Blount under this agreement during the twelve (12) month period prior to the cause of action. Learn With Cat/Cat Blount shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law. In no event will Learn With Cat/Cat Blount and/or their employees and/or assistants, and/or helpers be liable for the actions and/or words from learner[s] and/or learner parent[s], or anyone or anything outside of Learn With Cat/Cat Blount and/or their employees and/or assistants, and/or helpers.
I. General Representation and Warranty
You represent and warrant that (i) your use of the Website and participation in Learn With Cat’s services will be in strict accordance with the Learn With Cat/Cat Blount Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights and personal information of any other learner [children who participate in Learn With Cat courses].
J. Indemnification
You agree to indemnify and hold harmless Learn With Cat/Cat Blount, its contractors, and its licensors, and their respective directors, officers, employees and agents, and/or helpers from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website and participation in Learn With Cat/Cat Blount services, including but not limited to your violation of this Agreement.
K. Miscellaneous
This Agreement constitutes the entire agreement between Learn With Cat/Cat Blount and you concerning the subject matter hereof, and they may only be modified by the posting by Learn With Cat/Cat Blount of a revised version.
L. Communication
I do not provide correspondence or information of any matter regarding my learners and their scope of participation in my courses. This includes, but is not limited to references, grades, etc.
M. Privacy
Any information you provide to Learn With Cat/Cat Blount is subject to our private policy.
N. Membership
Only parents, facilitators, and/or adults over 21 can sign up a learner[s] for Learn With Cat. Each member can add multiple learners to their membership profile, however each child must be enrolled and/or subscribed to each individual course.
O. Courses / Visits
My courses are fun, but all learners must pay attention and follow the instructions for each course.
Visits will not be delayed for technical difficulties or other learner matters that last more than a few minutes. Everyone must come prepared to all of my visits.
All instructions and messages before, throughout, and after each visit must be read and adhered to.
Learners are to use Zoom from another device than the device you will use to interact in Roblox.
Parents and all other individuals who are not a part of my course[s] must remain off-screen throughout the entire visit.
Learners are to participate in the visit from a quiet room. Background noises pick up easily and can be disruptive.
All microphones and webcams are to be turned on and working properly.
All learners must be verified by me in the classroom at the beginning of each visit.
When learners enter the visit, they will be placed in a virtual waiting room. Each learner’s name must be identical to the username specified as a member of Learn With Cat.
